IndiGo Sues Mahindra Electric for Copyright Infringement over ‘6E’ Name of its New Car

IndiGo, India’s largest airline, has sued Mahindra Electric Automobile Limited for copyright infringement over their use of ‘6E’ in the name of its new car, BE 6e, since it is also the airline’s callsign.

IndiGo claimed that “6E” is not only its official designator but also a key aspect of its branding, covering a range of airline services like 6E Prime and 6E Flex.

In a statement, Indigo said, “The “6E” mark is an integral part of IndiGo’s identity for the past 18 years and is a registered trademark that holds strong global recognition. The “6E” mark, whether standalone or in its variants and formative forms, is extensively used by IndiGo for its offerings and for goods and services provided in collaboration with trusted partners.”

They added, “Any unauthorised use of the “6E” mark, whether standalone or in any form, constitutes an infringement of IndiGo’s rights, reputation, and goodwill. IndiGo is committed to taking all necessary and appropriate steps to safeguard its intellectual property and brand identity.”

The case was filed on Tuesday, December 4, 2024 and will come up for hearing on December 9. Justice Amit Bansal has chosen to recuse from hearing the matter.

IndiGo registered the mark ‘6E Link’ under trademark classes 9, 35, 39 and 16 in 2015, which allows for advertising and display for transport services. Meanwhile, Mahindra registered ‘BE 6e’ in class 12 on November 25 this year, which allows it to use 6e for a vast variety of vehicle types apart from two-wheelers.

Mahindra’s Response:

Mahindra & Mahindra have now addressed the situation by issuing a statement.

They said, “Mahindra Electric Automobile Limited, a subsidiary of the Company (“MEAL”), revealed its electric origin SUVs the BE 6e and XEV 9e on 26th November, 2024. MEAL has applied for trade mark registration under class 12 (vehicles) for “BE 6e” a part of its electric origin SUV portfolio.”

They added. “Hence, the Company does not see a conflict as Mahindra’s mark is “BE 6e,” not the standalone “6E.” It differs fundamentally from Indigo’s “6E,” which represents an airline, eliminating any risk of confusion. The distinct styling further emphasizes their uniqueness.”

Mahindra has reached out to the airline and is reportedly making efforts to discuss the issue.

The Mahindra BE 6e is expected to hit the roads in February 2025. It is also predicted to cost 18.90 lakh (ex-showroom) and compete with rival contemporaries like the Tata Curvv EV, MG ZS EV and the upcoming Hyundai Creta EV.
